OVERVIEW

This course can guide you when assessing your client’s problems with respect to foreign divorce. Specifically, the course will help you (1) analyze the timeline of Article 26 of the Family Code, (2) determine the practical issues that may arise in the absence of a divorce law, and (3) leverage House Bill no. 5487.

The course will also explore the following questions:

  • When a former Filipino has obtained a foreign divorce decree, is he/she still entitled to inherit form her former spouse? Claim any property rights from his former spouse?
  • What would you advise your foreign client who might have been a Filipino if he/she wishes to remarry after getting a foreign divorce decree?
  • How can your client prove that she/he is the administrator of the estate of his/her late spouse?
  • Is a foreign divorce obtained by a Filipino enforceable in the Philippines?
  • Is the Certificate of Divorce from your client enough to prove that he is not liable for bigamy?
  • How can we be sure that what was issued was an absolute decree of divorce thoroughly dissolving the marriage?

Professor

Atty. Katrina Legarda graduated from the University of Bristol, England in 1975, and obtained her degree in law from the University of the Philippines. She joined the Angara Abello Concepcion Regala and Cruz Law offices (ACCRALAW) in 1981.

She was the second female associate in ACCRALAW to specialize in the tough field of litigation. As ACCRALAW grew to become one of the biggest law firms in the country, Katrina rose through the ranks, eventually becoming a Partner before she withdrew in 1992 to concentrate on her advocacies for the woman and the child.
