OVERVIEW
Jurisprudence is replete with wars during estate proceedings. Who gets what is always the issue. It is not just whether a child is entitled to any inheritance in succession but also whether one is really the child of the decedent. There are issues that arise too in matters of support. Is the child yours that you may be obliged to support the child?
This course will help you (1) differentiate the two ways of classifying filiation, (2) explain the prescriptive period to impugn child’s legitimacy, (3) identify the questions that you need to ask your client if the legitimacy of the child is in question, and (4) determine the affirmative defenses available to the putative father.
